LEXINGTON, KY – QPWB Lexington office partner, James B. Compton, achieved a complete defense verdict in a workers’ compensation claim, resulting in long term monetary savings to his client. This case centered over the date of manifestation of the claim. Plaintiff pursued a claim of cumulative trauma for bilateral carpal tunnel syndrome and hernia claim due to a specific lifting incident at work. While the claimant alleged both the hernia and the bilateral carpal tunnel manifested during the client’s risk coverage period, QPWB successfully argued the claimant’s bilateral carpal tunnel manifested earlier than alleged, and, therefore, the bilateral carpal tunnel claim is barred by the Kentucky two (2) year statute of limitations.  Additionally, QPWB’s Workers’ Compensation Team successfully argued the claimant failed to carry the burden of proof relative to the claimant’s hernia allegation, as the doctor testifying on behalf of the claimant had a faulty medical history when rendering opinion on medical causation. It was undisputed the claimant needed corrective surgery for these three (3) physical problems about the hands and abdomen.

Kentucky Administrative Law Judge dismissed the case with prejudice.
