Richard W. Berne is a partner in the New York office of Quintairos, Prieto, Wood & Boyer, P.A. For the past 40 years he has represented clients and tried cases in the areas of personal injury, wrongful death, nursing home defense, medical malpractice, insurance defense litigation, insurance coverage disputes, general liability, workers’ compensation defense, criminal defense, governmental liability, and police misconduct.  Mr. Berne handles cases in state and federal courts from inception through settlement, trial and appeal, and has significant experience conducting mediations and arbitrations.  Mr. Berne’s extensive litigation experience includes handling corporate and business litigation matters involving contract disputes and related tort claims.

Prior to joining QPWB, he was a partner and managed the insurance defense team of a regional law firm in New York where he represented cases encompassing medical malpractice, nursing home defense, insurance coverage issues, appeals and administrative hearings.  Previously, and for over 17 years, he represented plaintiffs as a partner of a New York law office where he handled cases involving allegations of depravation of rights, privileges, or immunities secured by the Constitution and laws, 42 USC Sec. 1983.  His experience involved cases stemming from false arrest, malicious prosecution, police misconduct, personal injury and medical malpractice.  

For 15 years, Mr. Berne represented a vast number of federal felony and homicide cases as a partner in a law office in Bronx, New York.  He served as a certified member of the 18B panel and 18B Homicide Panel, a criminal defense panel limited to the most experienced lawyers with that particular area of the law.  During a two-year term, he also served as a member of the Central Screening Committee for the 18B panel; and served on the Criminal Justice Act (CJA) Panel for the Eastern and Southern Districts.  Mr. Berne commenced his legal career in 1977 as a staff attorney with the Legal Aid Society in Bronx, New York.

He received his Juris Doctor from Boston University School of Law in 1977 and Bachelor of Arts from Princeton University in 1974, graduating with a major in English Literature.

Mr. Berne is licensed to practice law in New York and is admitted in the U.S. District Court for the Eastern, Southern, and Northern Districts of New York, and the U.S. Court of Appeals for the Fourth Circuit.
