Employment Discrimination

FORT MYERS, Fla.Quintairos, Prieto, Wood & Boyer, P.A. (QPWB) partner Todd M. Smayda obtained a summary judgment for a South Florida Fire District in an employment discrimination action.  The summary judgment completely releases the Fire District from the action.  The plaintiff, a female firefighter, resigned after failing to pass physical agility tests for two years.  After the plaintiff resigned, she sued the Fire District for gender discrimination, hostile work environment, retaliation and negligent supervision.  Mr. Smayda shredded the plaintiff’s allegations by deposing her for over six hours and using her testimony against her at the hearing on the motion for summary judgment.  The Court determined the plaintiff could not prove a prima facie case for any of her claims and awarded summary judgment to the Fire District.
