osullivan_webJay D. O’Sullivan is a partner in the Miami office of Quintairos, Prieto, Wood & Boyer, P.A., focusing his practice in the area of complex/technical litigation. He has been engaged in the private practice of law since 1980 and represents clients through trial and post trial in multiple States and jurisdictions. Mr. O’Sullivan has extensive experience handling products liability defense, construction law, professional liability (architects and engineers), legal malpractice defense, property and casualty law, catastrophic loss defense, medical malpractice defense, toxic torts and food borne pathogens, health care law including professional licensing, hospital privileges and peer review, and primary and excess insurance coverage issues as well as bad faith litigation.

Mr. O’Sullivan represents clients in many industries in a wide range of legal matters, including heavy equipment manufacturing, engineering and environmental services, construction, aerospace, health care, and computer network and software providers, design, research and development. In addition to a law degree, Mr. O’Sullivan’s knowledge is enhanced by an engineering degree and years of experience as a mechanical engineer and as a facilities design engineer. He is well versed in utilizing his engineering and technology background, as well as litigation experience, to defeat sophisticated “junk” science and fraud claims brought against his clients.

Significant Representative Matters

  • Decker v. Bonita Boat Center, et al., Collier County (Florida) Case No. 02-1970-CA-HDH; 2½-week trial, Products liability, Plaintiff’s demand pre-trial was $5.7 million, Defense Verdict, June 2009.
  • Listman v. Outboard Marine Corp., Washoe County (Nevada) Case No. CV03-05022; Summary Judgment granted on day two of expected 3½ trial, Products Liability, Plaintiff’s demand was for $15 million, reduced to $800,000 on eve of trial.
  • Ruiz v. Marchetti, Monroe County (Florida) Case No. CAP030000189; two-week trial, complex brain damage case, Defense Verdict, June 2007. Plaintiff’s demand at trial was for $6.1 million. The excess carrier offered $1.3 million to settle prior to trial, which plaintiff turned down. The jury came back in 40 minutes with a defense verdict.
  • Ah Fook v. Outboard Marine Corp., • Skagit County (Washington) Cause No. 00-2-00761-5; 3½-week trial, Products Liability, Plaintiff’s demand at trial was for $18.1 million, Defense Verdict, June 2005.
  • Garrett v. Morgan, 127 Wn.App. 375, 112 P.3d.531 (2005).
  • Morgan v. PeaceHealth, 101 Wn.App. 750, 14 P.3d.773 (2000).

Previously, Mr. O’Sullivan was senior litigation counsel at Alvarez, Sambol, Winthrop & Madson, P.A., in Coral Gables, Fla., where he represented product manufacturers, design professionals, construction companies/sub-contractors, interstate trucking companies and insurance companies in complex litigation and mediation concerning professional liability, products liability, marine engineering, construction law, trucking law, property and casualty law, and coverage issues with an emphasis on catastrophic personal injury.

Prior to moving to Florida in 2006, Mr. O’Sullivan was a managing member of O’Sullivan & Blotch, PLLC in Seattle, Washington, where he handled numerous matters regarding complex, technically demanding litigation.  In Seattle, he was also a partner at Bassett & Morrison, where he handled complex products liability and coverage litigation involving the Alaska oil pipeline.

Mr. O’Sullivan is admitted to practice in Florida and in Washington; and before the U.S. District Court for the Southern, Middle, and Northern Districts of Florida; U.S. Court of Appeals for the Ninth Circuit, the U.S. Court of Appeals for the Eleventh Circuit; and the U.S. District Court for the Eastern and Western Districts of Washington.

Mr. O’Sullivan is a member of The Florida Bar (Trial Practice, Health Care and Administrative Law Sections); Washington State Bar Association (Trial Practice, Products Liability Construction, Administrative, and Health Law Sections); American Bar Association (Products Liability, Tort and Insurance Practice and Health Care Law Sections); Florida Defense Trial Lawyers and Defense Research Institute.

Mr. O’Sullivan received his Juris Doctor from the University of Puget Sound Law School in Tacoma, Washington in 1980, and a Bachelor of Science in Aerospace Engineering from the Rose-Hulman Institute of Technology in Terre Haute, Indiana in 1971.

Before entering law school, Mr. O’Sullivan served an active duty tour with the U.S. Army Europe (stationed in Germany) in field artillery, specializing in combat survey and special weapons, and successfully completed airborne training.  He left the Army Reserve as Captain in 1978.
