Gary J. Spahn, Jr., is an associate in the Orlando office of Quintairos, Prieto, Wood & Boyer, P.A.  Mr. Spahn focuses his litigation practice in the areas of medical malpractice, product liability, insurance defense, premises liability, construction law and collections.

Mr. Spahn received his Juris Doctor from Barry University School of Law, Orlando, Florida in 2007 and earned a Bachelor of Science in 2004 from James Madison University in Harrisonburg, Virginia.  During law school, Mr. Spahn was a member of the Trial Advocacy Team and gained other valuable courtroom experience as a Certified Legal Intern at both the office of the State Attorney in Orange County, Florida and the Department of Children and Families in Seminole County, Florida.   Mr. Spahn clerked for a Virginia firm which focused its practice on collections and compliance with the Fair Debt Collections Practices Act.  Prior to joining the QPWB team, Mr. Spahn expanded his areas of practice by working at a boutique law firm in the areas of product liability and insurance defense litigation, and at a medical malpractice defense firm.

Currently, Mr. Spahn is Co-Chair of the American Bar Association (ABA) Litigation Section Product Liability Young Lawyers’ Subcommittee, and serves as General Counsel to the Orange Soil & Water Conservation District, Orange County, Florida.  In 2008, he was selected for inclusion in both the Cambridge Who’s Who and the Madison Who’s Who publications.

Mr. Spahn is licensed to practice law in Florida’s state courts and is admitted to practice in the U.S. District Court for the Middle, Northern and Southern districts of Florida, as well as the U.S. Bankruptcy Court, Middle District of Florida.

His professional memberships include The Florida Bar; ABA - Litigation, Product Liability and Young Lawyers’ Product Liability Litigation Sections; Orange County Bar Association; Defense Research Institute; and the ABA Advisory Panel.

Mr. Spahn joined Quintairos, Prieto, Wood & Boyer in December of 2009.

 

Practice Areas:

Collections – Works with creditors obtaining past due monies, judgments and enforcing both in state and out of state judgments.  Mr. Spahn previously clerked for a Virginia law firm in the area of collections and provided advice and counsel regarding the Fair Debt Collections Practices Act, including preparation of an internal FDCPA compliance manual.

Condominium and Homeowner Associations -  Represents condominium and homeowner associations as well as their directors and officers in matters arising out of alleged violations of fiduciary duties, breach of contract and any and all other types of allegations arising from this area of law.

Construction Law – Represents companies defending against allegations of liability encompassing property damage, catastrophic bodily injury and death, ordinance and zoning violations, as well as statutory violations.  Mr. Spahn has gained valuable experience handling “Dig Law” violations; he has successfully obtained a voluntary dismissal with prejudice during mediation and has secured indemnity for contractors based on their subcontractors actions.

Contract Law – Works with individuals and corporations preparing and reviewing service and purchase contracts, creating and enforcing indemnity agreements and litigating breach of contract disputes.  In addition to general contract preparation and litigation, Mr. Spahn practices in the area of foreclosure defense.

Insurance Defense – Defends underwriting companies, insurance companies, as well as self-insureds against a vast variety of liability claims.  Mr. Spahn’s experience includes defending corporations against automotive liability, medical product liability, OTC supplement liability, general liability involving property damage, catastrophic bodily injury and death and claims against life insurance policies.

Medical Malpractice – Defends individual doctors, medical professionals, professional associations, and hospitals against allegations of medical negligence.  Mr. Spahn has worked with several trial teams in representing ophthalmologists, an orthopaedist, a mental health facility, a rehabilitation facility and several hospitals based on vicarious liability of their doctors and/or their staff.

Premises Liability – Represents various companies and business entities in a wide range of premises liability claims including slip and falls, negligent security, and code violations.

Product Liability – Defends manufacturers, distributors, and retailers in complex product liability litigation involving causes of action for a product’s defective design, defective manufacturing, defective or inadequate warnings and strict liability.  Mr. Spahn gained valuable experience working with a boutique product liability firm in the greater Orlando area.  His litigation experience includes defending medical device companies, industrial machine manufacturers, and an OTC supplement manufacturer, as well as providing legal support in connection with automotive litigation.
