Kevin W. Richardson is a partner in the Tampa office of Quintairos, Prieto, Wood & Boyer, P.A.  The focus of his practice is insurance defense, nursing home defense, hospital defense, administrative law, medical malpractice defense, auto liability defense and professional liability defense.

A graduate of the University of South Florida, Mr. Richardson received his Bachelor of Arts degree in History in 1994.  Mr. Richardson earned his Juris Doctor from the Nova Southeastern University’s Shepard Broad Law Center in 1997.  While in law school, he was named to the Dean’s List in the fall of 1994 and spring of 1996; he was a Moot Court Finalist in the spring of 1995, and an active member of the Moot Court Society throughout his legal education.  Mr. Richardson received the Book Awards for earning the highest final examination grades in Criminal Procedure, spring of 1996 and Trial Advocacy, winter of 1996.

After completing law school, Mr. Richardson became an Assistant State’s Attorney for the Thirteenth Judicial Circuit in Hillsborough County, Florida; he prosecuted various criminal offenses including homicide, vehicular homicide, drug trafficking, and white-collar criminal offenses. During his prosecutorial tenure, he tried more than 70 felony jury trials that included two successful first-degree murder verdicts.

In 2001, Mr. Richardson joined the law firm of Quintairos, McCumber, Prieto & Wood, P.A., where he participated in the defense of numerous nursing home lawsuits, practiced hospital malpractice defense and professional liability defense. In 2003, Mr. Richardson became a founding shareholder in what became McCumber, Inclan, Daniels, Buntz, Richardson, Hartig & Puig, P.A., and managed the firm’s Orlando office. In August 2006, Mr. Richardson rejoined Quintairos, Prieto, Wood & Boyer, P.A., as a partner.

In February 2004, Mr. Richardson was trial counsel in the Estate of Evelyn Ross v. Adventist Health System/Sunbelt Inc., d/b/a ACC Courtland. The case was tried in the Ninth Judicial Circuit in and for Orange County.  The allegations were made under the "new law" provisions of Chapter 400, and both death and survival damages were sought. Plaintiff alleged that the facility staff at ACC Courtland was negligent in failing to prevent two falls Ms. Ross sustained during her residency.  The matter was tried successfully to a defense verdict.

In December 2004, Mr. Richardson was trial counsel in Angeline Nastasi v. SHCC Services, Inc. d/b/a Florida Living Nursing Center.  The allegations were that the Plaintiff, Angeline Nastasi, while visiting residents of the Florida Living Nursing Center, was walking across the main entranceway and tripped and fell over a speed bump. The speed bump, placed in that location to slow traffic, was alleged to have been improperly maintained and located in an area accessible by pedestrians; it was alleged that the painted safety stripes had become faded, and were not vivid enough to place pedestrians on notice of its existence. Mrs. Nastasi suffered a four-part comminuted fracture of her shoulder joint, and also claimed to have suffered a fractured knee.  Ultimately, her shoulder injury required a hemi-arthroplasty surgical procedure to replace those portions of the joint that had been fractured.  The defense utilized the testimony of an expert orthopedist to establish that the fractured knee, not diagnosed at the time of the initial injury, more likely than not occurred following the initial fall at Florida Living.  The matter was tried successfully to a defense verdict.

In June 2002, Mr. Richardson was trial counsel in the Estate of Annie Johnson v. NHC, et. al., in Hernando County, Florida.  Plaintiff’s allegations included abuse and neglect that caused death during the nursing home residency of Annie Johnson. The trial lasted one week and resulted in a verdict favorable to the defense.

Mr. Richardson has been voted, by his peers, as a “Top Up & Comer” in the Florida Trend 2006 issue of Legal Elite. He is a member of The Florida Bar; the Hillsborough County Bar, and the Orange County Bar.  In 2006, Mr. Richardson was appointed to sit on the Animal Law Committee of the Florida Bar.  Mr. Richardson is also a member of the Defense Research Institute, the Florida Health Care Association and the Florida Association of Homes for the Aging.
