JACKSONVILLE, Fla. ― Dennis P. Dore a partner, and Luis R. Guzman a lawyer, from the Jacksonville office of Quintairos, Prieto, Wood & Boyer, P.A., obtained a defense verdict on behalf of a large retailer after a plaintiff alleged he tripped and fell on an exterior sidewalk of the retailer’s local store.

Prior to the trip and fall, the plaintiff testified he was walking beside another patron who moved over on the sidewalk to avoid overgrown plants, causing the plaintiff to step on the sidewalk’s edge and fall.  The contentions supported by an expert architect stated the sidewalk was improperly elevated causing a dangerous edge and that the overgrown plants were improperly maintained.  The claimed damages included a displaced fracture of the upper extremities and aggravation of pre-existing complex Post Traumatic Stress Disorder.

The jury returned a complete defense verdict in 35 minutes of deliberations.
