GEORGIA COURT OF APPEALS AGREES WITH DEFENSE
GEORGIA COURT LACKS PERSONAL JURISDICTION OVER DEFENDANT

ATLANTA ― QPWB Atlanta office attorney, Geoffrey F. Calderaro, secured the dismissal of our client before the Court of Appeals of Georgia in a case that arose from the dismissal of a complaint filed on account of allegedly unpleasant visit to Appellant’s timeshare in Kissimmee, Florida.

On appeal, Appellant argued that the trial court was wrong to dismiss his case for lack of personal jurisdiction. Appellee countered by arguing that the Superior Court of Gwinnett County should be affirmed since the Superior Court lacked personal jurisdiction pursuant to O.C.G.A. § 9-10-91. The defense argued that the facts of the case clearly demonstrated that the correct location for this suit was in Florida since the purchase of the timeshare occurred in Florida, the acts or omissions occurred in Florida, no tortious injury was committed in the State of Georgia, and there was no allegation that the Appellee owned, used, or possessed any real property in the State of Georgia.

The Court of Appeals of Georgia affirmed the judgment of the Superior Court of Gwinnett County Georgia.
