AGAINST A SPECIALTY HOSPITAL

Wendy A. McMillon and Frank Alvarez, trial lawyers in the Dallas office of Quintairos, Prieto, Wood & Boyer, P.A., obtained summary judgment in a medical malpractice case in Tarrant County, Texas, on behalf of their client, one of the nation’s leading specialty hospitals.

Plaintiffs alleged a 72-year-old patient suffered a fall while hospitalized at the facility and asserted defendants should have better managed the patient’s underlying fall risk factors to prevent the fall. The plaintiff further alleged a subdural hematoma was suffered during a ground level fall at the facility, which ultimately caused the patient’s death, should have been diagnosed and treated sooner. Plaintiffs sought $2,000,000 in damages for mental anguish, emotional distress, and loss of consortium in the wrongful death action.

The Court granted the Defendants’ Traditional and No-Evidence Motion for Summary Judgment, and the defendants were entirely dismissed from the case.

Frank Alvarez is the Managing Partner of the Dallas office. Wendy A. McMillon is a partner in the Dallas office. She has spent over 25 years representing complex, multi-party commercial matters, family dispute actions, and complex and catastrophic injuries and damages.  The focus of her practice in the areas of general liability defense in personal and commercial lines of business specifically includes: professional negligence, medical malpractice, nursing home defense, and health care litigation; automobile, trucking and motorcycle; construction defect; product liability; negligent security and premises liability; negligent hiring and supervision; insurance coverage and bad faith litigation. Ms. McMillon’s practice includes serving as mediator, arbitrator and in alternative dispute resolution. She is a credentialed mediator with the Texas Mediator Trainers Roundtable.
