TAMPA, Fla. Todd Michael Smayda, a partner in the Tampa office, won a summary judgment for his client in a construction negligence case. Mr. Smayda represented an entity that performed private party building code inspection services in a case where the Plaintiff alleged his client, and others, were responsible for dangerous conditions on the building site which caused the plaintiff serious head injuries. Mr. Smayda was successful in arguing that his clients, as code inspectors, had no legal duty to the injured worker, thus ending the case after almost three years of contentious litigation.
