Dental Malpractice Trial – Negligence

COOK COUNTY, IL ― QPWB Chicago partner John P. Prusik, obtained a defense verdict before a jury on behalf of his client, a dentist, on various allegations including breach of standard of care. The plaintiff, a 37-year-old female, claimed that the defendant, a general dentist, was negligent when the tip of the dental instrument separated and became lodged in the plaintiff’s tooth during a root canal. The plaintiff further alleged that the dentist over prescribed antibiotics, was not qualified to perform the root canal, and made an inadequate referral to an endodontist.  The plaintiff claimed the defendant’s negligence breached the standard of care and that such breach caused pain, suffering and economic loss.

The defense argued and proved that the dentist was qualified to perform a root canal, did not breach the standard of care and that a dental file tip breaking during a root canal is a known risk and complication. Additionally, the defense pointed out the dentist properly stopped the root canal procedure, prescribed antibiotics to prevent infection and appropriately referred the plaintiff to an endodontist to remove the file tip and complete the root canal.

The plaintiff asked for $100,000 in damages. The Cook County jury returned a defense verdict, concluding the defendant-dentist did not breach the standard of care.
