WEST PALM BEACH, Fla. – Michelle D. Cofiño, a partner in the Miami office of Quintairos, Prieto, Wood & Boyer, P.A., upheld a summary judgment victory in a benzene case after Oral Argument before the Fourth District Court of Appeal. The plaintiff has a rare form of cancer that could be caused by exposure to benzene, a chemical contained in the mineral spirits allegedly sold by our client, a leading Florida fuel and bulk oil distributor. Most of the other defendants settled their claims. We urged client to stay strong and won on summary judgment argued by Reginald J. Clyne, drafted by Kimare S. Dyer, both whom are partners in the Miami office, on the issue there was insufficient evidence to establish causation against our client. The plaintiff appealed to the Fourth District Court of Appeal where the defense fully briefed the issues and prevailed on oral argument by Michelle D. Cofiño. The appellate court affirmed the trial court’s orders granting the defense’s Summary Judgment.
