QPWB SECURES DEFENSE VERDICT IN AUTOMOBILE COLLISION CASE
NEW YORK ― September 18, 2022 ― Kathleen M. Mulholland, a partner in QPWB’s New York office, recently obtained a favorable verdict on a liability claim. The action arose out of a motor vehicle collision between the plaintiff who was riding a bicycle, and the defendant, who was driving a car. Ms. Mulholland represented the insured who allegedly struct the bicyclist. Plaintiff sued QPWB’s client and a co-defendant who was doubled parked causing the plaintiff to maneuver around the vehicle and allegedly contributing to the accident. Prior to trial, Plaintiff demanded in excess of $500,000 to settle the case and rejected a high-low offer whereby plaintiff would be awarded no less than $275,000.00 and no more than $750,000. The last offer made was $150,000. After a one-week trial, the jury found QPWB’s client 78% at fault but found that the plaintiff did not sustain the traumatic injuries he was claiming. The jury only awarded $65,000.00 in total damages.
