Erick S. Durlach is a partner in the Scottsdale, Arizona office at Quintairos, Prieto, Wood & Boyer, P.A.  He represents clients in Arizona, California, Colorado and New York.  Mr. Durlach represents clients in the areas of business law, construction law, professional liability and real estate.  Additionally, Mr. Durlach handles matters involving distressed commercial loan facilities, loan workouts, creditors’ rights, distressed asset dispositions and acquisitions.  He has significant trial and arbitration experience and has been practicing law since 2001.  During his years of practice, Mr. Durlach has achieved favorable resolutions of large, complex, high-profile cases. Representative Experience

Commercial Litigation and Business Disputes

Representation of local, national, and global companies and financial institutions in breach of contract matters, business torts and other business disputes.

  • Successfully represented international engineering firm by resolving contentious litigation for $0.  Plaintiff asserted breach of contract and interference with contract claims and demanded $1.3 million.  After obtaining dismissal of three of plaintiff’s four claims, plaintiff was forced to walk away from its remaining claim 3 months before trial.  In addition, the court granted multiple discovery motions and awarded client approximately $40,000 in fees and costs. (2016)
  • Obtained dismissal of client contractor against plaintiff’s multi-million dollar negligence and breach of contract claims relating to arson fire at a commercial building by enforcing the terms of the contract, and recovered all of client’s attorneys’ fees and costs. (2015)
  • Defense verdict on behalf of a recreational vehicle retailer and recovery of attorneys’ fees, while nullifying plaintiff’s claims for breach of contract, rescission and consumer fraud.
  • Successfully defended an alarm and security company against multi-million dollar breach of contract and negligence claims relating to an alleged brain injury caused by carbon monoxide poisoning by enforcing the terms of the alarm contract.
  • Successfully defended national bank in mortgage resolution matters, including mortgage related litigation, where plaintiffs alleged breach of contract, consumer fraud, and related mortgage fraud claims.
  • Obtained summary judgment and dismissal of an action against a financial institution relating to breach of contract, fraud, misrepresentation and indemnification claims.

Construction Law

Representation of local, national and international contractors against breach of contract and negligence claims relating to the construction of commercial structures and residential dwellings.

  • Successfully defended a general contractor against a $40 million breach of contract claims relating to the construction of a premier, AAA 4-Diamond resort.

Professional Liability

Representation of architects and engineers against breach of contract and negligence claims relating to the design of commercial structures.

  • Successfully defended an architect against $50 million breach of contract claims relating to the design of a $600 million public project.

Employment Law / Restrictive Covenants 

  • Successfully persuaded the Court to issue a permanent injunction order, enforcing the restrictive covenants contained in an internet-based company’s employment agreement against a former employee who was hired by a direct competitor.  The restrictive covenants included a nationwide covenant not to compete, and non-solicitation and non-disclosure provisions.

Wrongful Death & Catastrophic Injury 

Representation of companies, including contractors, bus companies, trucking companies, and healthcare facilities, against wrongful death and catastrophic injury claims.

  • Obtained a partial summary judgment for a healthcare facility by persuading the court to dismiss the plaintiffs’ multi-million dollar punitive damages claim in a wrongful death action.
  • Successfully defended an alarm and security company against multi-million dollar breach of contract and negligence claims relating to an alleged brain injury caused by carbon monoxide poisoning by enforcing the terms of the alarm contract.
