QPWB ATTORNEY GETS COMPLETE DEFENSE VERDICT
IN AN ADMITTED LIABILITY CASE

JACKSONVILLE, Fla. ― Dennis P. Dore, a partner in the Jacksonville office of Quintairos, Prieto, Wood & Boyer, P.A. (QPWB), received a complete defense verdict in a tender rejection case on behalf of GEICO, the clients’ carrier. Mr. Dore was assisted in the trial by partner, Nikki Hawkins, also from the Jacksonville office.
The essential facts included an admitted liability rear-end motor vehicle accident where the plaintiff’s vehicle was “totaled.” The plaintiff was removed from the scene by ambulance. He came under the care of a rehab facility for seven months, and was then referred to an orthopedic surgeon, who eventually recommended surgery for his shoulder, ulnar nerve and carpal tunnel. He was also referred to a neurosurgeon who then recommended neck and back surgery, and another specialist who recommended knee surgery, with obvious permanent impairments.
The medical specials for the surgeries alone exceeded $300,000. The plaintiff also had a life care expert, who is also a physiatrist associated with the University of Florida, who opined future medical specials totaling more than $500,000. The defense arranged a compulsory medical examination (“CME”) with results indicating no permanent impairment, but that a course of conservative care was reasonable. The defendants’ policy limits had been tendered and rejected, and a significant confidential extra contractual amount had been offered and rejected.
After two hours of deliberations, the jury answered the first question: “Was the negligence on the part of the defendants a legal cause of loss, injury or damage to the plaintiff?” Their answer was no! Accordingly, the defendants obtained a complete defense verdict in an admitted liability case with significant property damage, and six surgical recommendations.
